1. About DesireMe

These Terms and Conditions govern your use of desire-me.com and its related services (the “Platform”). The Platform is operated by DesireMe, located at Business Address (“DesireMe”, “we”, “us” or “our”).

DesireMe is an online marketplace that allows adult users to buy and sell permitted physical items and digital photos or videos. By creating an account, listing an item or placing an order, you agree to these Terms and our Privacy Policy.

2. Adults Only

You must be at least 18 years old and legally able to enter into a contract to use the Platform. You must not allow a minor to use your account or upload, request, buy or sell content involving a minor. We may request identity and age verification at any time and may suspend accounts that fail verification.

3. Accounts

You must provide accurate information, keep your login details secure and notify us at desireme.team@gmail.com if you suspect unauthorised use. You are responsible for activity through your account. Accounts may not be sold, transferred or shared.

4. Buyer and Seller Responsibilities

DesireMe provides the marketplace, but unless we expressly state otherwise, the Seller is responsible for the item or content offered. Sellers must own or have permission to sell each listing and must provide accurate descriptions, prices and delivery information.

Sellers of digital photos or videos must ensure every person shown is at least 18 years old and has consented to the creation, upload and sale of the content. Sellers must keep reliable age, identity, consent and ownership records.

Buyers must use purchased items and digital content lawfully. Digital content is for the Buyer’s private, personal use and must not be copied, recorded, resold, published or shared without the Seller’s written permission.

5. Prohibited Items and Conduct

Users must not list, request, buy, sell or share:

· content involving or appearing to involve anyone under 18;

· non-consensual intimate content, secretly recorded material, exploitation, coercion, trafficking or blackmail;

· illegal, stolen, counterfeit, dangerous, contaminated or prohibited goods;

· bodily fluids, controlled substances, weapons or any item prohibited by a carrier or applicable law;

· sexual services, in-person sexual arrangements or attempts to use the Platform for prostitution or trafficking;

· content that infringes privacy, copyright, trademarks or other rights; or

· fraudulent activity, harassment, hate content, malware, payment abuse or attempts to bypass Platform controls or fees.

We may remove content or restrict an account where we reasonably believe these Terms, safety requirements or applicable law have been violated.

6. Orders and Payments

Prices, delivery charges and applicable taxes are shown before an order is confirmed. Payments and Seller payouts are processed by an independent payment provider. Users may also be required to accept that provider’s terms and privacy notice.

The payment provider may delay, reject, reverse or investigate a transaction for fraud, chargeback, verification, sanctions or legal-compliance reasons. DesireMe does not store complete payment-card numbers when they are collected directly by the payment provider.

7. Physical Items and Delivery

Sellers must package physical items discreetly, securely and hygienically and dispatch them within 10 business days unless the listing states otherwise. Buyers are responsible for providing a correct delivery address and paying disclosed shipping, customs or import charges.

A Buyer should report a missing, damaged, defective or materially misdescribed item to desireme.team@gmail.com within 10 days after delivery or the expected delivery date. We may request photographs, tracking information or other reasonable evidence.

8. Digital Content

Digital photos and videos will be made available using the delivery method stated at checkout. A Buyer may request help where paid content is not delivered, cannot be accessed or is materially different from its description. Access may be removed if payment is reversed or the content violates these Terms.

9. Cancellations and Refunds

An order may be cancelled before the Seller dispatches or delivers it, unless processing has already begun or the listing clearly states otherwise. After dispatch or digital delivery, refunds are generally available only where an item is not delivered, defective, materially misdescribed, inaccessible, duplicated or charged without authorisation, or where required by law.

Because some physical items are hygiene-sensitive, change-of-mind returns may be refused after sealed packaging has been opened where this was disclosed before purchase and is permitted by law. Refunds are processed through the original payment method. Nothing in this section limits mandatory consumer rights.

10. User Content and Intellectual Property

You retain ownership of content you upload. You give DesireMe a non-exclusive, worldwide, royalty-free licence to host, display, technically format and use that content only as needed to operate, protect and promote the Platform. This licence ends when the content is deleted, except where continued retention is reasonably required for backups, completed transactions, legal obligations, safety or disputes.

The DesireMe name, website design, software and materials are owned by or licensed to us. They may not be copied, scraped, reverse engineered or commercially reused without permission.

11. Suspension and Termination

You may close your account by contacting desireme.team@gmail.com. We may remove listings or restrict, suspend or close an account where reasonably necessary to protect users, investigate fraud or illegal activity, comply with law, address payment risk or enforce these Terms.

12. Disclaimers and Liability

We aim to provide a secure and reliable Platform but do not guarantee that it will always be available or error-free. We do not guarantee a user’s identity, behaviour, listing, delivery or transaction. A verification badge shows only that stated checks were completed; it is not an endorsement or guarantee.

To the extent permitted by law, DesireMe is not responsible for indirect or consequential losses or losses caused by another user, carrier, payment provider or external service. Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded, including under Japan’s Consumer Contract Act.

13. Changes to These Terms

We may update these Terms when reasonably necessary for legal, security or service changes. We will publish the revised version and effective date and provide appropriate notice of significant changes. We will obtain consent where required by law.

14. Japanese Law and Disputes

These Terms are governed by the laws of Japan. Please contact desireme.team@gmail.com first so that we can try to resolve a complaint. Subject to mandatory consumer-protection rules, disputes will be submitted to the court having jurisdiction over our registered office in Japan.
